2. User Eligibility and Conduct Commitments
Age Requirements and Legal Capacity You must be at least 18 years old, or meet the legal age requirement for digital consent in your jurisdiction to register and use the Pinka Platform. By registering an account or using the services, you affirm that you are fully capable of entering into a legally binding contract. If you do not meet the minimum age requirement, you are prohibited from using the Pinka Platform. Any accounts found in violation of this rule will be suspended or deleted.
Accurate Account Information When registering or updating your account, you agree to provide truthful, complete, and up-to-date information. It is strictly prohibited to use false identities, impersonate others, or register accounts on behalf of someone else. Any violation of this rule may result in your account being suspended or terminated.
Account Responsibility and Security You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. If you suspect that your account has been accessed by unauthorized parties, please contact us immediately at service@pinka.live.
Restricted Regions and Compliance In compliance with international export control and sanctions regulations, Pinka does not provide services to individuals or entities located in or affiliated with the following regions: Cuba, Iran, North Korea, Syria, Sudan, and Crimea. By using the Pinka Platform, you confirm that you are not located in or associated with any of these restricted jurisdictions and that your use of the services does not violate any applicable laws or sanctions regulations.
3. User Accounts and Security
Account Registration To create an account on the Pinka platform, users are required to provide basic information such as:
• Username: A unique identifier for your account.
• Email Address: Used for account verification, communication, and password recovery.
• Password: A secure password to protect your account from unauthorized access. When registering, you agree to provide accurate, complete, and up-to-date information. It is your responsibility to maintain the accuracy of your account information.
Account Security You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You should take necessary precautions to prevent unauthorized access to your account, such as using a strong password and logging out from shared devices. If you suspect any unauthorized access to your account or any breach of security, you must notify us immediately via service@pinka.live. Pinka is not liable for any loss or damage arising from unauthorized access to your account.
Account Deletion You may request to delete your account at any time by following the procedures provided in the app. Once your account is deleted, it cannot be restored. Any content or data associated with your account may be permanently lost. However, we may retain certain data as required by applicable law or for legitimate business purposes, such as fraud prevention or compliance with legal obligations. By requesting account deletion, you acknowledge and agree that Pinka is not responsible for any consequences resulting from the permanent removal of your data.

• Sending Virtual Gifts: Viewers can send virtual gifts to broadcasters as a form of appreciation and interaction, enhancing the live-streaming experience.
• Content Interaction: Users can engage with content through likes, comments, and reactions. This allows for dynamic and real-time interaction between creators and their audience.
• Customizable Profiles: Users can personalize their profiles with images, bios, and other content to better express their identity and connect with others.
Recommendation System Pinka uses intelligent recommendation algorithms to offer personalized content suggestions based on your interests, activity, and interaction patterns on the platform. These recommendations include:
• Trending channels and broadcasts tailored to your preferences.
• Suggested creators and content based on your past interactions and activity.
• Algorithmically ranked clips, ensuring that the most relevant and popular content reaches you in a timely manner. These features are designed to make it easier for users to discover content that aligns with their interests, while continuously adapting to your preferences as you interact with the platform.
User-Uploaded and Shared Content Pinka allows users to upload, share, and broadcast various types of content on the platform, including but not limited to:

If your account is deleted, you may lose access to any purchased services, virtual goods, or rewards associated with the account. It is your responsibility to ensure that you have backed up any important content before submitting a deletion request.
8. Virtual Goods and In-App Purchases
8.1 Definition and Scope of Virtual Goods
On the Pinka platform, you can purchase virtual credits (such as coins, gems, etc.) through deposits. These credits can then be used to purchase the following virtual goods or services:
• Virtual gifts (to be sent to streamers or other users);
• Interactive items such as special effects, comment styles, stream room decorations, and other related elements;
• Temporary features or membership privileges (e.g., priority recommendations, special identity display);
• Other digital items or services offered by the platform.
These virtual goods are exclusive to the Pinka platform and have no real-world monetary value. They are non-transferable, non-redeemable, and cannot be withdrawn as cash.
8.2 In-App Purchases and Payment Rules
You can make in-app purchases through official app stores like Apple App Store, Google Play, or other designated channels. All transactions are processed by third-party payment platforms, and Pinka does not directly store user payment information.

• Please ensure that your payment details are accurate. The platform is not liable for any losses caused by incorrect information;

8.3 Virtual Goods Usage Rules
• Some virtual goods may have an expiration date (e.g., time-limited items), after which they will automatically become invalid;
• If your account is suspended due to violations, unused virtual goods may no longer be available for use, and the platform will not provide compensation;
• Virtual gifts are considered voluntary purchases, and the platform does not intervene in any gifting-related disputes or personal matters between users.
8.4 Refund Policy
Given the digital nature of virtual goods, once a purchase is made, it is considered final, and refunds are not supported. However, refunds may be considered under the following circumstances:
• Double charges caused by platform malfunctions or system errors;
• Any other situations that are explicitly specified by law.
If you made a payment through Apple or Google, please follow their platform’s refund policies, as Pinka does not directly handle refund requests outside the platform.
8.5 Platform Modifications and Liability Disclaimer
Pinka reserves the right to adjust the names, pricing, features, and display formats of virtual goods as necessary for operational purposes. Any changes will be communicated to users through platform announcements or update notifications in advance.
The platform does not assume responsibility for the following situations:
• Account theft or misoperations due to personal negligence;
• Loss of virtual assets caused by illegal plugins or third-party tools;
• Inability to use virtual goods due to account suspension or termination.
9.Payment Terms and Transaction Management
9.1 Payment Methods and Supported Channels Pinka offers a variety of payment options to ensure users can easily complete top-ups and purchases. The following are the main payment channels we support:
• In-app payments through Apple App Store (for iOS users) and Google Play (for Android users);
• Local payment services available in specific regions, offering users convenient transaction options.
All payments are processed through third-party payment platforms, and we do not directly store or handle users' payment details. The success or failure of a transaction is fully dependent on the outcome of these payment providers.
9.2 Transaction Records and Invoice Viewing Pinka provides an easy way for users to view transaction history. Users can access all payment details, including recharges, purchases, and subscriptions, through the “Account” section in the app. Invoices and receipts will be issued by the respective payment platforms or partners, in accordance with applicable regulations. If you have any questions regarding your bill, please verify the transaction details and reach out to customer support for assistance.
9.3 Payment Failure and Issue Resolution Process If you experience issues such as payment failure, unprocessed top-ups, or incomplete orders, please follow the steps below:
1 Ensure your network connection is stable and not causing any interruptions during the payment process;
2 Verify your account balance or payment method to confirm that it is functioning properly;
3 If the issue persists, take a screenshot of the order page and contact Pinka customer support. We will promptly assist you in resolving the issue.
9.4 Payment Disputes and Platform Responsibility If a user encounters a dispute with a third-party payment platform (e.g., incorrect charges or denied refund requests), Pinka will provide necessary transaction records and support, but will not directly handle disputes outside of the platform. We reserve the right to take appropriate actions against fraudulent transactions, malicious disputes, or unusual refund requests, including but not limited to freezing accounts, suspending withdrawals, and other related measures.
10.Subscription Services
10.1 Overview of Subscription Services Pinka offers subscription services designed to provide users with a premium experience, including but not limited to:
• Custom identity badges or exclusive titles;
• Enhanced priority in live stream recommendations;
• Removal of ads, early access to new features and content;
• Other periodic privileges offered by the platform.
The specific benefits, pricing, and duration for each subscription plan will be clearly displayed on the relevant page. Pinka reserves the right to adjust subscription content as needed, with prior notification to users.
10.2 Auto-Renewal Policy If you subscribe to a service through platforms such as Apple App Store or Google Play, the system will automatically renew your subscription before the end of the subscription period:
• The system will attempt to process the renewal 24 hours before the current subscription expires;
• Upon successful payment, your subscription period will automatically be extended;
• If the payment fails, the system will continue to try to process the payment in the following days.
You can disable the auto-renewal function in your Apple or Google account settings at any time. After cancellation, the subscription will not renew for the next period, but you will still have access to the service for the remainder of the current period.
10.3 Free Trial and Promotional Offers Certain subscription services may offer free trials or promotional discounts. Once the trial period ends, the system will automatically charge you at the regular price unless you cancel the subscription before the trial ends. Specific rules for promotional offers will be provided through platform announcements or page notifications, and will vary depending on the offer.
10.4 Refund Policy Once a subscription service is activated, it is considered to be in use, and no refunds will be provided during the subscription period. However, if any of the following occur, you may apply for a refund:
• Duplicate charges caused by system errors or technical issues;
• Incorrect charges resulting from platform errors.
If your subscription was purchased through Apple or Google, refund requests should follow the respective platform's refund policies. Pinka does not handle refund requests outside of these platforms.
11. User Conduct and Platform Usage
Prohibited Conduct To maintain a safe and positive environment, Pinka strictly prohibits the following behaviors:
• Malicious Behavior: Engaging in actions intended to harm the platform, its users, or any third parties, including spamming, hacking, or attempting to gain unauthorized access to any part of the platform.
• Fraudulent Activities: Using the platform to deceive, defraud, or mislead others. This includes but is not limited to fake accounts, impersonating others, or making fraudulent claims about services or products.
• Infringement of Rights: Uploading, sharing, or distributing content that infringes upon the intellectual property rights, privacy rights, or any other rights of others, including copyright violations, unauthorized sharing of personal data, or the use of pirated materials.
• Abusive or Harassing Behavior: Any form of harassment, bullying, threatening, or discriminatory behavior directed at other users based on their race, religion, gender, sexual orientation, or other personal characteristics.
• Improper Use of Third-Party Tools: Using unauthorized third-party tools, bots, or scripts that interfere with the functionality of the platform, disrupt normal operations, or unfairly manipulate features such as content ranking or engagement metrics.
Violations and Consequences Pinka reserves the right to take appropriate action in response to any violations of these terms, including but not limited to:
• Content Removal: Any content that violates our terms will be promptly removed from the platform.
• Feature Restrictions: Users found engaging in prohibited conduct may have access to certain features of the platform restricted, including limitations on content creation, messaging, or interactions with other users.
• Account Suspension or Termination: In cases of serious or repeated violations, Pinka may suspend or permanently ban the user’s account.
• Legal Action: In cases involving fraud, illegal activity, or other serious violations, Pinka may escalate the matter to law enforcement authorities or take legal action as necessary to protect the platform and its users.
Pinka encourages users to report any behavior that violates these terms or makes the platform unsafe for others. All reports will be investigated and acted upon in accordance with our community guidelines and platform rules.
12. Privacy and Data Usage
At Pinka, we place great importance on your privacy and are committed to handling your personal data in a responsible manner.
Collection and Use of Your Information During your use of Pinka's services, we may collect certain data, including registration details, your interactions with the platform, device identifiers, and other related information. This data is used to improve platform functionality, offer personalized content recommendations, ensure the security of the platform, and comply with relevant laws and regulations. 13.Termination and Account Suspension
Account Suspension and Restrictions Pinka reserves the right to suspend or restrict access to your account if you violate the terms of service or engage in illegal activities. This may include, but is not limited to, violations of community guidelines, fraudulent activity, abuse, harassment, or any other conduct that threatens the safety, integrity, or reputation of the platform. If your account is suspended or restricted, you will be notified by Pinka, and you may be required to provide additional information or take corrective actions to regain access. In cases of serious or repeated violations, your account may be permanently banned without prior notice.
Account Deletion You may request to delete your Pinka account at any time. Once your account is deleted, all associated data, including content you have uploaded or interacted with, will be permanently removed. Please note that certain data may still be retained by Pinka as required by law or for operational reasons, such as maintaining transaction records or compliance with legal obligations. Once your account is deleted, it cannot be restored, and all data will be irretrievably lost.
14. Legal Disclaimer and Limitation of Liability
Services Provided "As-Is" The services provided by Pinka are offered on an "as-is" basis. Pinka makes no representations or warranties, whether express or implied, regarding the functionality, reliability, availability, or security of the platform or its services. By using the platform, you acknowledge and agree that you are doing so at your own risk. Pinka does not guarantee uninterrupted access to the services, and the platform may experience downtime or technical issues from time to time.
Limitation of Legal Liability Pinka will not be held responsible for any direct, indirect, incidental, special, or consequential damages arising out of or related to your use or inability to use the services, including but not limited to loss of data, loss of revenue, or other economic damages. Pinka is not liable for any damages that result from errors, interruptions, or defects in the services, or from actions taken by users or third parties.
Governing Law and Dispute Resolution This agreement shall be governed and enforced to the fullest extent permitted under applicable laws.Any disputes, controversies, or claims arising out of or relating to this agreement, including any issues regarding its existence, validity, or termination, shall be resolved by binding arbitration under the administration of the Singapore International Arbitration Centre (SIAC), in accordance with the SIAC arbitration rules in effect at the time of the dispute. The arbitration proceedings shall be conducted in English, and the final award rendered by the arbitration panel shall be binding upon both parties.
15. Governing Law and Dispute Resolution
Governing Law
This agreement shall be governed by and construed in accordance with the applicable local laws to the fullest extent permitted, without regard to conflict of laws principles. The laws applicable to any legal proceedings shall be based on the laws of the location where the platform operates, and such laws shall take precedence in resolving any legal issues related to this agreement.
Dispute Resolution
Any disputes arising out of or in connection with this agreement shall first be attempted to be resolved through amicable negotiation between the parties. If the dispute cannot be resolved within fourteen (14) days, it shall be submitted to binding arbitration in accordance with the applicable arbitration rules. The arbitration shall take place in the location where the platform operates and shall be conducted in English. The decision of the arbitrator shall be final and binding on both parties. If arbitration is not chosen, the dispute may be resolved through litigation in the competent courts of the location where the platform operates.
16. Modifications to the Agreement
We reserve the right to modify or update the terms of this agreement as needed, based on changes in our business, legal requirements, or service offerings. Any changes will be reflected in the "Effective Date" at the top of this document. In the case of significant changes, we will make an effort to notify you through notifications within the app, emails, or other visible means. By continuing to use the Pinka services after these updates are made, you acknowledge and accept the revised terms. If you disagree with the updates, you should cease using the services and contact us with your concerns.
17. General Provisions
This agreement, together with our Privacy Policy and any other applicable terms, constitutes the complete understanding between you and Pinka concerning the use of the services. If any part of this agreement is found to be invalid or unenforceable, the remaining provisions shall still remain in effect. The section titles in this agreement are for reference purposes only and should not be used to interpret the content of the clauses.
